The petitioners through instant petition under Articles 226/227 of the Constitution of India are seeking direction to respondents No. 1 and 2 to issue them passport.

An FIR No. 143 dated 28.08.2009, under Sections 306 and 34 of IPC was registered against the petitioners at Police Station, Dirba. The petitioners came to be convicted vide judgment dated 02.06.2011 passed by trial Court. The petitioners preferred CRA-1768-SB of 2011 before this Court. Sentence of the petitioners was suspended vide order dated 3.11.2011 passed by this Court.

Learned counsel for the petitioners submits that case of the petitioners is squarely covered by judgment of this Court in Mohan Lal @ Mohna vs. Union of India and others 2023 SCC Online P&H 1391. 4.

Mr. Deepanjay Sharma, DAG, Punjab, who on advance is present in Court, does not dispute the aforestated factual position. 5.

Learned counsel for Union of India, who on advance notice is present in Court, submits that petitioners may be directed to appear before the passport authority alongwith requisite documents and the passport authority, thereafter, would pass an appropriate order after considering the afore-stated judgment within four weeks.

Learned counsel for the petitioner agrees to the aforesaid arrangement.

The petitioners are directed to appear before the passport authority on 06.10.2023 at 10.00 am alongwith requisite documents. On doing so, the passport authority would pass an appropriate order, in accordance with law, within four weeks from 06.10.2023. 8.

The petition stands disposed of.
