This order shall dispose of two appeals bearing FAO-M-45-2018 and FAO-M-47-2018 both titled as Amandeep Kaur versus Gurvinder Singh. FAO-M-45-2018 has arisen from the judgment and decree dated 15.01.2018 by which petition filed by the respondent-husband under Section 13 of the Hindu Marriage Act, 1955 was allowed. FAO-M-47-2018 has arisen from the judgment and decree dated 15.01.2018 by which petition filed by the appellant-wife under Section 9 of the Hindu Marriage Act, 1955 for restitution of conjugal rights was dismissed. During the pendency of these two appeals, the matter was referred to the Mediation and Conciliation Centre of this Court where the parties have AMIT KAUNDAL 2018.12.04 13:37 I attest to the accuracy and integrity of this document
FAO No.M-45 of 2018 (O & M) FAO No.M-47 of 2018 (O & M) -2entered into a compromise, which has been reduced into writing on 14.11.2018. In terms of the compromise, the respondent-husband has handed over two drafts of `17,00,000/- each drawn separately in the name of appellant-wife and minor son, namely, Samarveer Singh. The amount of `34,00,000/- has been paid by the respondent towards full and final settlement. In view thereof, learned counsel for the appellant prays for withdrawal of both the appeals.
Thus, both the appeals are dismissed as withdrawn and decree of divorce granted to the respondent-husband by the trial Court is upheld.
