-.- AMIT RAWAL J. (ORAL) Mr. Khurana submitted that he received telephonic information from his client i.e. plaintiff that partition proceedings had been finalized.

The present regular second appeal is arising out of dispute with regard to injunction against the co-sharer, which has been dismissed by both the Courts below. Once partition proceedings had attained finality, no useful purpose would be served in keeping the regular second appeal arising out of injunction to be pending. The regular second appeal is dismissed as having become infructuous with liberty to revive the same in case information provided to Mr. Khurana is found to be incorrect.
