(Oral) Learned counsel for the petitioner would contend that suit for partition was filed by the petitioner-herein, who was about 80 years of age in the year 2010. Thereafter, preliminary decree was drawn up on 09.02.2016 and the final decree was drawn up on 27.02.2020. The defendant-respondents were ex-parte throughout the proceedings. Now in the appeal filed by the defendantrespondents, status quo has been directed to be maintained regarding possession, construction and alienation. Learned counsel for the petitioner further contends that he does not wish to press the revision petition on merits, however, he prays that keeping in view the fact that petitioner, who is above 80 years and has been litigating since 2010, the hearing of the appeal may be expedited.

I find the request of learned counsel for the petitioner to be fair. Accordingly, in view of the above, the present revision petition is dismissed as not pressed with a request to the Appellate Court to expedite the hearing of the TRIPTI SAINI 2022.04.04 22:20 I attest to the accuracy and integrity of this document
