Tribhuvan Dahiya, J (Oral) This is a petition for setting aside order dated 25.08.2022 passed by the Family Court granting monthly interim maintenance of ` 4,000 to the respondent-wife and ` 3,000 to the minor child, apart from litigation expenses of ` 5,000.
Learned counsel for the petitioner contends that the wife has not been faithful to the petitioner, and has cheated him by withdrawing huge amounts of money from the joint account of the parties. He contends that the petitioner has no objection to payment of maintenance to the minor, but maintenance to the wife is not justified on account of aforesaid submissions. The Family Court has only awarded interim maintenance vide the impugned order. The facts regarding allegations of withdrawing of amounts by the respondent-wife have also been considered by the trial Court and has observed that trial is at the initial stage, and in order to prove the facts, evidence from both the sides needs to be led. Admittedly, the AVIN KUMAR 2023.02.17 11:50 I attest to the accuracy and integrity of this order/judgment
CRM No.1000 of 2022 [2] petitioner is getting net pension of ` 18,561. Keeping in view the facts aforesaid, as also stage of the trial before the Family Court, there is no ground to interfere with the impugned order.
