(ORAL) The present petition has been filed under Articles 226/227 of the Constitution of India inter alia seeking issuance of a writ in the nature of Mandamus for directing the respondents to either hand over the vacant possession of auctioned land in favour of the petitioner after getting it vacated from the unauthorized occupants or refund the entire auction money along with interest.

At this stage, Mr. Vishal Tartyal, Advocate appears and files his Vakalatnama on behalf of respondent No.8- Gram Panchayat Siunti, Tehsil and District Pathankot in Court today, which is taken on record, subject to all just exceptions. He submits that the possession of the land auctioned in favour of the petitioner has already been delivered to the petitioner on 09.06.2025, however, the said fact is denied by learned counsel appearing for the petitioner.

Be that as it may, the petitioner is directed to approach the concerned Block Development and Panchayat Officer on 04.08.2025 at 11:00 HIMANI GUPTA 2025.08.02 15:33 I attest to the accuracy and integrity of this document

A.M., where the Gram Panchayat through its authorized representative/ Sarpanch shall also appear at the said date and time and execute a formal document of handing over the possession of the land to the petitioner after ensuring that the land taken in auction by the petitioner is free from all encumbrances.

Keeping in view of the above, the present petition is disposed of accordingly.
