(ORAL) This intra court appeal under clause X of the Letters Patent Act is directed against the judgement and order of the learned Single Judge dated 31.07.2017 whereby the writ petition filed by the petitioner (appellant herein) challenging inquiry initiated against him was dismissed with a direction to conclude the said proceedings within a period of six months from the date of receipt of a certified copy of the order. 2.

During the pendency of this appeal, in compliance of the directions issued by the learned Single Judge, the disciplinary inquiry has been completed and vide order dated 06.04.2018, the petitioner was downgraded to the cadre of Development Officer, Grade-I from the cadre of Administrative Officer (Scale-I).

Since the punishment has been inflicted upon the petitioner after the disciplinary inquiry, the same is a fresh cause of action which is open to challenge by the petitioner in case he so desires in appropriate proceedings before appropriate forum.

In so far as the present appeal is concerned, it has lost its efficacy and rendered infructuous.

The appeal accordingly stands dismissed as infructuous.

Since the appeal has been dismissed as infructuous, all the miscellaneous applications filed therein stand disposed of.
