The petitioner is seeking the concession of bail under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023 in case FIR No.50 dated 17.04.2024 under Section 61 of the Punjab Excise Act, 1914 of the IPC registered at Police Station Jhabal, District Tarn Taran. 2.

Learned counsel for the petitioner submits that in compliance of the following order dated 11.11.2024 passed by a Coordinate Bench of this Court, the petitioner has joined investigation and cooperated with the investigating agency:- "Keeping in view the fact that recovery has already been effected from petitioner, therefore, in the meantime, in case petitioner is arrested, he be released on interim bail to the satisfaction of Arresting Officer/Investigating Officer subject to condition that petitioner will join investigation as and when required. He will not tamper with or interfere with investigation and will not leave the country without prior permission as provided under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023." Per contra, learned State counsel, on instructions, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioner is not required for further investigation much less for his custodial interrogation.

On a pointed query put to the learned State counsel, he, on instructions, has further submitted that the petitioner has no previous criminal antecedents.

In view of the above, the petition is allowed and interim order dated11.11.2024, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C./482(2) of BNSS, 2023.
