Prayer made in the present petition is for directing the respondents to grant minimum of the Regular Pay Scale plus Dearness Allowance along with arrears and interest for the post of Staff Nurse at par with regular employees in terms of the judgment of the Hon'ble the Supreme Court in State of Punjab and Others vs. Jagjit Singh, 2016(4) SCT 641 2.
Learned counsel submits that the relief as claimed in the present petition, stands extended to similarly circumstanced, vide judgment dated 25.11.2024, Annexure P-5 and implemented vide orders dated 12.05.2025, 19.06.2025 and 25.05.2025, Annexures P-7 and P-8 respectively. In this regard, a legal notice dated 27.05.2025, Annexure P-13, has been served upon respondents, however, the same has yet not evoked any response. He thus, on instructions prays that a direction may be given to respondent No.1 to decide the same keeping in view the aforesaid judgments and orders in a time bound manner. Learned State counsel has no objection to the limited prayer made. 4. In view of the above and without commenting on the merits of the case, this petition is hereby disposed of with a direction to respondent No.1 to decide the legal notice dated 27.05.2025, within a period of 6 months, taking note of the afore-referred judgments and orders, which this Court has no reason to believe the authorities would not address in a just, fair and reasonable manner. Upon doing so, after notice and hearing offered to them and if found entitled, grant the benefit forthwith.
