Learned counsel for the petitioner would contend that the petitioner was promoted to the post of Lower Divisional Clerk. However, due to personal difficulty, he was unable to join and made a request vide application dated 19.05.2003 for foregoing the promotion. The said application for foregoing the promotion was kept pending and was accepted only in the year 2009 thereby depriving the petitioner from being considered for promotion in the year 2006 i.e. after a period of three years. Learned counsel for the petitioner would further contend that in this regard a legal notice dated 12.10.2021 (Annexure P-8) has been sent to the respondents, however, no decision has been taken qua the same. Learned counsel for the petitioner limits his prayer and states that at this stage he would be satisfied if a direction is issued to respondent No.4 to take a decision on the legal notice dated 12.10.2021 (Annexure P-8) in a time-bound manner. On the asking of the Court, Ms. Kanica Sachdeva, AAG Punjab accepts notice on behalf of respondent No.1-State while Mr. Vikas Mehsempuri, Advocate accepts notice on behalf of respondent Nos.2 to 4. The counsel state that they have no objection if the present writ petition is disposed off with a direction to respondent No.4 to decide the legal notice dated 12.10.2021 (Annexure P-8) in a time-bound manner. Heard.
In view of the limited prayer made by learned counsel for the petitioner and without commenting on the merits of the case, the present writ petition is disposed off with a direction to respondent No.4 to take a decision on the legal notice dated 12.10.2021 (Annexure P-8) expeditiously, in accordance with law, and in any case within a period of two months from the date of receipt of a certified copy of this order. Disposed off accordingly.
