Appellants-defendants are in second appeal. For convenience parties hereinafter are referred to by their original position in the suit, i.e. the appellants as defendants and the respondents as plaintiffs. Defendant No.1-appellant No.1 is present in person. He has been identified by his counsel, Mr. Shreenath A.Khemka, Advocate. He submits that though his grievance is with respect to denial of his rights qua allotted surplus land in 1975. He wants to reserve his rights qua the same. He undertakes not to file any complaint against respondent No.1-plaintiff No.1 in person.
