In the present appeal, the challenge is to the impugned judgement dated 21.11.2016 passed by the learned Single Judge in CWP No. 13505 of 2016.

After arguing for some time, learned Senior counsel for the appellant argues that the only apprehension of the appellant is that, keeping in view certain observations made by the authorities including the learned Single Judge, upon reconsideration of the issue, revenue authority might be influenced by the same, hence, a direction may kindly be issued to the authorities concerned to ensure that while considering the claim of the respondents afresh with regards to the partition of the land in question which

LPA-230-2017 -2has already been done, the authorities shall apply their mind independently and pass an appropriate speaking order in accordance with law keeping in view all the relevant facts which have been brought on record to be kept in mind while re-considering the mode of partition which includes the value of the land as well.

Learned counsel for the respondents on the other hand does not raise any objection to the said plea.

Keeping in view the above, the present appeal is disposed of with the observation that any observation made by any authority while remanding the case back including those made by the learned Single Judge, will not influence the revenue authorities while deciding the issue afresh and the issue of partition of land will also be decided on the basis of the fact as well as the mode of partition already agreed upon between the parties to partition the land in question by keeping in mind the value of land as well. 4.

It may be noticed that as the partitions proceedings are pending since long before the authorities concerned, the said authorities are directed to finalize the said partition proceedings within the period of four months from the date of receipt of certified copy of this order. 5.

The present appeal is disposed of in above terms. 6.

Pending civil miscellaneous application(s), if any, stand disposed of.
