 It has been submitted by learned counsel for the petitioner that the petitioner is in custody for 3 months and 11 days and it is a case where the investigation of the case has already been completed and the final report under Section 173   '       ) -  &  has been presented to the competent Court. She further submitted that even as per the allegations, there is no overt act which has been committed by the petitioner or any other co-accused in the present FIR and the present FIR was lodged purely on the basis of suspicion

 




that the petitioner and the other co-accused were preparing for robbery. She also submitted that the similarly situated co-accused, namely Jaswinder Singh @ Jass Bhangu, who is at parity with the present petitioner has already been extended the benefit of regular bail by this Court in CRM-M-39531 of 2023 on 18.08.2023 vide Annexure P-2. She also submitted that the petitioner is not involved in any other case and has clean antecedents. She further submitted that in view of the aforesaid facts and circumstances, ' may be considered for the grant of regular bail. Reference was also made pertaining to the bail order of one other co-accused, namely, Gopal Singh who has also been extended the benefit of regular bail by this Court in CRM-M-41788 of 2023 on 31.08.2023 and the present petitioner is at parity with the aforesaid co-accused as well. 3.

submitted, on instructions from ASI Gurmeet Singh, that it is correct that the petitioner is in custody for 3 months and 11 days and it is also correct that the petitioner is not involved in any other case and has clean antecedents. He further submitted that the present petitioner is at parity with the aforesaid two co-accused who have been granted regular bail vide Annexure P-2 and P-3 by this Court. 4.

I have heard learned counsel for the parties. 5.

It is a case where the petitioner has already faced incarceration for 3 months and 11 days and two of the co-accused who are at parity with the present petitioner, have been granted regular bail vide Annexure P-2 and P-3 by this Court. In view of the aforesaid facts and circumstances, the present petitioner also deserves the concession of regular bail. 5-6$ the present petition is allowed. ,''
