-.- AMIT RAWAL J.(ORAL) The appellant-plaintiff is aggrieved of the dismissal of the suit seeking declaration that imposition of order of recovery of `3,89,267/- on account of alleged embezzlement committed while discharging function of the Sarpanch of Village Tajpur being illegal and null and void by both the Court below on the premise that alternative remedy of appeal lies before the DDPO as per Section 216 of the Punjab Panchayati Raj Act.
In view of the aforementioned, I am of the view that there is no illegality and perversity as the suit was without jurisdiction. No ground for interference is made out, much less, no substantial question of law arises for determination by this Court. The appeal is dismissed.
