Prayer in the instant petition filed under Article 226 of the Constitution of India is for issuance of a writ or direction in the nature of Habeas Corpus directing the respondent-authorities to get the detenue namely Shalika d/o Lt. Joginder Pal and w/o petitioner be released as she is being kept in illegal custody of respondents No.4 and 5. 2.

Statement of the alleged detenue has been recorded in compliance of order dated 05.09.2024 before the learned CJM, Amritsar, which has been received. The same has been opened and perused in Court today and marked as 'A'. As per the statement of the alleged detenue, she does not wish to return to the company of her husband. She has categorically stated that she would want to continue living with her mother and brother i.e. private respondents No.4 and 5. In view of the statement made by the detenue, aged about 30 years, no ground is made out to interfere or issuance of further directions. Hence, the petition stands dismissed.
