By way of present petition filed under Section 482 of CrPC, prayer has been made for issuance of direction to respondents No.2 and 4 to form a Special Investigating Team for conducting fair and just enquiry in the matter as the private respondents have committed offence of murder of Lovepreeet Singh @ Labba. 2.

Status report by way of affidavit of Bhupinder Singh Bhullar, PPS, Deputy Superintendent of Police (Narcotics), Moga, Addl. Charge of Deputy Superintendent of Police (City), Moga, District Moga is filed in Court today, the same is taken on record. Be tagged at appropriate place.

At the outset, learned counsel for the petitioner submits that instead of pressing the present petition on merits, his client would be satisfied in case direction is issued to the respondents to decide the representation (Annexure P-3) moved at the instance of petitioner by passing a speaking order expeditiously.

Learned State counsel representing respondents No.1 to 5 and raises no objection to the innocuous prayer made on behalf of the petitioner.

In view of the agreed stand taken by both sides, but without going into the merits of the controversy, the present petition is disposed of with a direction to respondents No.3 and 4 (Senior Superintendent of Police, Barnala and Senior Superintendent of Police, Moga) to look into the representation (Annexure P-3) and take appropriate action in accordance with law by passing a speaking order preferably within a period of 04 (four) weeks from the date of receipt of certified copy of this order.
