Present:

Mr.Sunil Agnihotri, Advocate for the appellant. ........

SURYA KANT, J.(ORAL) CM-5172-LPA-2017 For the reasons mentioned in the application, the same is allowed and delay of 38 days in refiling the appeal is condoned. CM stands disposed of.

CM-5173-LPA-2017 As prayed for, application is allowed subject to all just exceptions.

LPA-2340-2017 Father of the appellant was working as 'Assistant Line Man' when he unfortunately died in harness on 05.04.2002. The appellant is said to have applied for his appointment on compassionate ground in the year 2002 itself. It appears that he sat at home and did not pursue the application. He got some information under the RTI Act in the year 2016 and filed writ MEENU 2018.08.16 09:42 I attest to the accuracy and authenticity of this document chandigarh

CM-5172-5173-LPA-2017 in/and LPA-2340-2017 (O&M) -2petition seeking a direction for his appointment on compassionate ground under the 'Old Ex-Gratia Policy'. Learned Single Judge has turned down the claim vide order under appeal.

[2] We have heard learned counsel for the appellant and gone through the record. It appears that there are hardly any mitigating circumstances as of now to direct the respondents to consider the appellant's claim for the reason that for 14-15 years, he has survived without any murmuring. He himself is responsible for allowing the grass to grow under his feet as no Forum was ever approached by him for expeditious consideration of his claim.

[3] No case to interfere with the order under appeal is made out. [4] Dismissed.
