**** AMIT RAWAL, J. (ORAL) Petitioner is seeking indulgence of this Court for issuance of a writ in the nature of mandamus directing the respondents to restore the petitioner on the post of Adolescent Health Counselor (Male) (contractual), as he has been illegally adjusted on a post of Special New Care Unit Counselor having lower salary despite the fact that the post of Adolescent Health Counselor is lying vacant at C.H.C. Bhiwani. In this regard, had submitted notice dated 28.08.2019 (Annexure P-4), but there is no adherence thereto.

Learned counsel for the petitioner submits that petitioner will be satisfied if a direction is issued to respondent No.3 to consider the notice dated 28.08.2019 (Annexure P-4) within a stipulated period. Without going into the merits and demerits of the claim of the petitioner, I deem it appropriate to direct respondent No.3, to consider the

YOGESH SHARMA 2019.10.15 15:50 I attest to the accuracy and integrity of this document CWP-28614-2019 (O&M) notice dated 28.08.2019 (Annexure P-4) and decide the same within a period of two months from the date of receipt of certified copy of this order, by passing a speaking order after affording opportunity of hearing to petitioner, failing which, respondent No.3, shall be liable to pay costs of `25,000/- to petitioner.

This condition of imposing costs is only to prevent petitioner to run from pillar to post and avail remedy of contempt in case of noncompliance of directions issued by this Court.
