LPA-1029-2018 The appellant is aggrieved by the order dated 21.05.2018 vide which the ex-parte stay order dated 06.04.2016, whereby operation of the order of dismissal of respondent No. 1 was stayed and he was required to be kept under deemed suspension, was ordered to be continued. It is urged that the pleadings in the writ petition are complete since long and even an application moved by the appellant under Article 226 clause (3) of the Constitution of India, seeking vacation of an ex-parte stay order, is pending consideration nearly for the past two years, but owing to the continuation of the stay order, the interest of the appellant continues to suffer.

Be that as it may, for the learned Single Judge is in seisin of the dispute and the matter is posted for 03.08.2018, we are dissuaded to interfere with the impugned order. Even otherwise, we are sanguine that if the appellant would apprise the Court of the difficulty it is faced with and press its application seeking vacation of an ex-parte stay order, the Court shall pass appropriate orders.

The appeal is accordingly disposed of in the above terms.
