CM 16423/2019 has been filed for placing on record correct/amended Memo of Parties in substitution of Memo of Parties originally attached with the writ petition. It is stated therein that due to clerical/typographical mistake the name of petitioner company had been wrongly mentioned in the Memo of Parites, which is now sought to be corrected.

For the reasons stated in the application, the same is allowed and correct/amended Memo of Parties, annexed with the application is taken on record in substitution of Memo of Parties earlier filed with the writ petition.

Registry to place the same at the appropriate place in the paper book.

CWP 28328/2019 (O&M) Prayer in the present petition under Article 226/227 of the Constitution is for issuance of Writ of Certiorari for setting aside the order dated 17.07.2019 Annexure P-15 passed by Deputy Commissioner, Gurugram withdrawing the order dated 18.9.2013 whereby Petitioner-company had been granted temporary permission to block access through part of the passage falling in Khasra No.264/2(0-18) subject to the petitioner company providing alternative passage for use by the residents of the Gram Panchayat, Behrampur, Tehsil Wazirabad, District Gurugram, upto such time that the construction being raised by the petitioner-company reaches ground level.

After arguing for sometime, counsel for the petitioner prays for permission to withdraw the writ petition. Dismissed as withdrawn.
