*** HARSIMRAN SINGH SETHI , J. (ORAL) In the present writ petition, it is stated that husband of petitioner, namely, Sh. Chiman Lal @ Chaman Lal, was working as a Sweeper in the Municipal Council, Kotkapura, District Faridkot and while in service, he unfortunately died on 15.07.2017. Counsel for the petitioner argues that after the death of the husband of the petitioner, she made several representations to the respondents to release the benefits in respect of the service rendered by her late husband with the Municipal Council, Kotkapura, District Faridkot and also for grant of family pension, but despite an expiry of more than two years, no benefit has been released to her, though, respondent No.4Executive Officer, Municipal Council, Kotkapura has already written a letter to respondent No.3-Deputy Director, Local Bodies Government of NARESH KUMAR 2019.10.05 11:25 I attest to the accuracy and integrity of this document Chandigarh
CWP-28482-2019 -2Punjab, Ferozepur that pensionary benefits and the family pension to the petitioner be approved for releasing the same. Counsel for the petitioner states that no action is being taken by the respondents and hence, a direction be issued to the respondents to release the pensionary benefits to the petitioner in respect of the service rendered by her late husband as well as the family pension after his death. Counsel for the petitioner further states that for the relief which has been sought in the present writ petition, petitioner has submitted a representation dated 'nil' (Annexure P-2) to respondent No.4 , which is still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said legal notice.
In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioner, respondents are directed to decide the representation dated 'nil' (Annexure P-2) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioner is entitled for any monetary benefit, the same shall also be released to her within a period of three months thereafter. Present writ petition stands disposed of.
