(ORAL) CM-5369-C-2021 For the reasons stated in the application and also even otherwise case of the petitioner is covered by the judgment rendered by a Coordinate Bench of this Court in case titled as Rajinder Singh Vs. Jaswinder Kaur and others passed in CR No.3428 of 2017 decided on 07.12.2017 reported as 2018 (2) PLR 62, prayer for refund of Court fee of both the parties is allowed.

Registry to take steps accordingly.

Application stands disposed of.

CM-5370-C-2021 This is an application for disposing of the Regular Second Appeal in terms of compromise dated 11.10.2021 (Annexure A-6) and also making the said compromise a part of the decree sheet. For the reasons stated in the application, same is allowed and Annexure A-6 is taken on record.

On oral request, the main appeal, which is otherwise pending for 22.05.2022, is taken up on Board today itself. Main case Regular Second Appeal herein is against the appellate judgment and decree dated 24.09.2015 passed by learned Additional District Judge, Patiala whereby, appeal against trial Court judgment and decree dated 30.09.2013 was dismissed and the judgment and decree of the learned Lower Court was upheld.

Learned counsel for the appellants submits that a compromise/settlement agreement dated 11.10.2021 (Annexure A-6) has been reached and reduced into writing between the parties. Therefore, he prays that the present appeal may be disposed of in terms of the aforesaid settlement agreement.

In view of the fact that the matter has been compromised between the parties, the present appeal is disposed of in terms of the settlement agreement dated 11.10.2021 (Annexure A-6) with liberty to the non-applicant-respondents to seek their remedy, in case they have any grievance qua the compromise. The said settlement agreement dated 11.10.2021 shall form part of the decree sheet. Parties to remain bound by terms of the compromise.
