The appellant was a candidate for appointment to the post of Lecturer in Geography (School Cadre). While applying on-line, she mentioned that she acquired the qualification of M.A. in Geography in the year 2002. At the same time she relied upon the experience gained before 2002. The Selecting Authority, therefore, did not award her any marks under the head of 'Experience'.

[2] Consequently, she was not selected. Had the appellant been awarded marks for the experience which she was actually having, she would have been selected.

[3] The fact of the matter is that the appellant had acquired the M.A. qualification in the year 1999 from Panjab University. At that time, Meenu 2017.05.10 15:35 I attest to the accuracy and authenticity of this document chandigarh

LPA-323-2017 (O&M) -2she secured 468 marks out of 1000. Later on she applied for improvement and successfully improved her M.A.qualification and her marks were increased from 468 to 515 in June 2002.

[4] There was no requirement of minimum qualifying marks in M.A. as an eligibility condition for the post of Lecturer in School Cadre. Thus, if the appellant had applied on the basis of her original degree of 1999, she would have been selected because in that case she would have got marks for experience as well.

[5] Faced with this, learned counsel for the appellant seeks to withdraw this appeal with liberty to move an application before the learned Single Judge for the recall of the order and/or to permit the appellant to submit a fresh representation to the Competent Authority in the light of the facts noticed above.
