  certiorari quashing the order dated 22.08.2024, Annexure P-4, whereby the petitioner has been relieved from assignment as Assistant Professor (Temporary), despite availability of workload in the Department.   !

   contends that the petitioner was engaged as Assistant Professor (Temporary) in the Department of Education purely on contract basis for a period of six months against leave vacancy vide letter dated 01.01.2024, Annexure P-2. However, he was allotted work in the Department of Physical Education. Later, the tenure of contractual engagement was extended from 02.07.2024 to 24.08.2024 vide letter dated 06.08.2024, Annexure P-3. Since Dr. Yogesh Chander, Associate Professor in Department of Physical Education, who was on Seema 2024.09.19 13:41 I attest to the accuracy and integrity of this document

  deputation, joined back on 22.08.2024, the petitioner was relieved from service. It is further contended that the post has again fallen vacant as Dr. Yogesh Chander has been relieved to join a new assignment as Professor in Physical Education at Sports University of Haryana, Rai, and has been granted Extra Ordinary Leave without pay for one year from 23.08.2024 to 22.08.2025. The petitioner is, accordingly, entitled to be considered for adjustment against the vacant post. He has made a representation to that effect also, but the same has not been considered. "

Mr. Amarjit Singh Virk, Advocate appearing on advance notice, on instructions, contends that there is no workload for contractual teachers in the Department of Education/Physical Education, since a newly appointed regular Associate Professor in the Department of Physical Education-Dr. Babita has joined on 05.09.2024. In the absence of any workload, the petitioner cannot be re-engaged. He further contends that the University is not engaging any other Assistant Professor on contract basis in the Department to replace the petitioner. As and when the need arises, he shall also be considered for engagement.

In view thereof, there is no ground to entertain the petition and it stands   ,TRIBHUVAN DAHIYA- #$ $% $&
