The present revision petition has been filed against impugned order dated 11.07.2024 passed by the trial Court whereby the application filed under section 239 Cr.P.C. to drop the proceedings against the petitioner was dismissed. 2.

Counsel for the State on instructions submits charges against the petitioner have already been framed vide order dated 18.01.2023. He submits that once a judicial order has been passed framing the charges, that judicial order must be explicitly challenged which has not been done in the present case.

On this, counsel for the petitioner intends to withdraw the present petition with liberty to file fresh petition and also that the time for which the present petition remained pending in this Court, shall not be counted for the purpose of limitation. Given above, the present petition is hereby, disposed of, as withdrawn with liberty as prayed for. It is clarified that filing and disposal of the present petition shall not come in the petitioner's way. All pending application(s), if any, stand disposed of.
