This is a petition under Section 438 of the Code of Criminal Procedure, 1973 for grant of anticipatory bail to the petitioner in FIR No.0005 dated 28.09.2022 under Section 498-A of the Indian Penal Code, 1860 registered at Police Station Women Police Station, Sangrur, District Sangrur.

Vide order dated 10.11.2022 the arrest of the petitioner was stayed. Thereafter, the petitioner was directed to join investigation vide order dated 05.05.2023. On 08.08.2023 though the learned counsel for the State, PARKASH CHAND 2023.09.20 10:59 I attest to the accuracy and authenticity of this order/judgment.

2023:PHHC:123241 CRM-M-48849-2022 -2on instructions from HC-Gurmandeep Singh, submitted that the petitioner had joined investigation and was fully co-operating and that he was not required for further custodial interrogation, however, only for the purpose of exploring the possibility of arriving at an amicable settlement, the matter was adjourned to today. Today the learned counsel for the petitioner has pointed out that there is no chance of an amicable settlement as after the passing of the order dated 08.08.2023 a fresh complaint has been given by the complainant against the petitioner. The learned counsel for the State, on instructions from ASI-Avtar Singh, has reiterated that the petitioner has joined the investigation and he is no longer required for custodial interrogation.

In view of the above the orders dated 10.11.2022 and 05.05.2023 are made absolute. The petitioner shall, however, join investigation as and when called. The petitioner shall also abide by all the terms and conditions as specified under Section 438(2) of the Code of Criminal Procedure, 1973.

Disposed off accordingly. Pending applications, if any, also stand disposed off.
