MANJARI NEHRU KAUL, J. (ORAL) Petitioner is seeking the concession of anticipatory bail under Section 438 of the Cr.P.C. in case FIR No.67 dated 08.04.2023 under Sections 419/420/467/468/471/120-B of the Indian Penal Code, 1860, registered at Police Station Civil Lines, Amritsar. While issuing notice of motion on 19.09.2023, following contentions of learned counsel for the petitioner were recorded:- "Learned counsel for the petitioner, inter alia, contends that the petitioner has been arraigned as an accused on the basis of a disclosure statement allegedly suffered by one of the co-accused Kamalpreet, who stated that he was part of a gang being operated by co-accused Gajinderjit Singh, which had cheated the complainant of crores of money by attempting to execute a sale deed with respect to SCO No.94 located at Ranjit Avenue, Amritsar." Thereafter, vide order dated 31.10.2023, the petitioner had been granted interim anticipatory bail with direction to join investigation. CRM-M-47266-2023 -2Learned counsel for the petitioner submits that in compliance of order dated 31.10.2023, the petitioner has joined investigation and cooperated with the investigating agency. Learned State counsel, on instructions from ASI Palwinder Singh, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. He on further instructions submits that the petitioner is not required for further investigation much less for his custodial interrogation. In view of the above, the petition is allowed and interim order dated 31.10.2023, is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C.
