Through this petition a direction is sought to respondent No.2 to expeditiously decide the petition filed by the petitioner on 28.09.2022 under Section 42 of the East Punjab Holdings (Consolidation and Prevention of Fragmentation) Act, 1948 (for short- 1948 Act) as according to the petitioner a decision in such petition has been unnecessarily delayed. 2.

After hearing learned counsel for the parties and going through the record, the undisputed facts which have been emerged are that in the year 2014 Karan Singh etc. had filed a petition before the Tehsildarcum-Consolidation Officer under Section 21(2) of the 1948 Act, which was allowed on 18.01.2022. Execution of the said order was resulting in effecting the rights of the petitioner and therefore to challenge the order dated 18.01.2022, the petitioner approach respondent No.2 through filing of a petition under Section 42 of the 1948 Act. 28.09.2022 and notice was issued for 20.10.2022. Thereafter, after completion of pleadings, decision on the same is being unnecessarily delayed, causing prejudice to the petitioners. 3.

At the outset learned State counsel who appears on advance notice submits that the petitioners' petition filed on 28.09.2022 under Section 42 of the 1948 Act shall be decided in accordance with law by respondent No.2 within 03 months from the date of a receipt of copy of this order.

The afore statement satisfies the learned counsel for the petitioners.
