* * * * KRISHNA MURARI, C.J. (ORAL) Case called out. No one appears on behalf of the appellant to press the appeal. However, we have perused the record. Learned Single Judge by means of the judgement and order dated 18.05.2018 which is under challenge in this appeal dismissed the writ petition filed by the appellant (petitioner therein) claiming compassionate appointment. 2.
Undisputedly, the appellant, who is 37 years of age, approached this Court challenging the order dated 02.01.2018 declining request for her compassionate appointment. She claimed to be daughter of one Constable Balwinder Singh who died on 22.05.1988. There does not appear to be any dispute in respect of the fact that after death of Balwinder Singh, his widow (mother of the appellant) performed second marriage with Harjinder Singh, brother of the deceased and on her request he was given compassionate appointment as long back as on 02.06.1994. Once compassionate appointment has been given at the request of the widow as long back as on 02.06.1994, the claim of the daughter for compassionate appointment after AMODH SHARMA 2018.08.21 10:29 I attest to the accuracy and integrity of this document
LPA-1176-2018(O&M) attaining the age of 37 years from any point of view is not liable to be entertained and the learned Single Judge rightly dismissed the writ petition. We do not find any illegality in the impugned order which may require interference. 3.
The appeal is devoid of merits and accordingly stands dismissed.
