AT CHANDIGARH CRM-M-44807-2024 Date of decision: 24.02.2025 SUKHCHAIN SINGH AND ORS
...Petitioner(s)
VERSUS
STATE OF PUNJAB AND ANOTHER
...Respondent(s)
CORAM:
HON'BLE MR. JUSTICE H. S. GREWAL
Present:
Mr. Inderpal Singh Deol, Advocate, for the petitioners.
Mr. Amandeep Singh Samra, AAG, Punjab.
Ms. Harnaaz Kaur Hundal, Advocate for the complainant.
**** H. S. GREWAL, J. (Oral) 1.
The petitioners have filed the present petition under Section 528 of the Bharatiya Nagrik Suraksha Sanhita, 2023 for quashing of FIR No.136 dated 25.07.2024 for the offence punishable under Sections 115(2), 303(2) and 3(5) of BNS registered at Police Station Sadar, District Hoshiarpur. The basis for seeking this relief is the compromise deed (Annexure P-2), whereby they claim to have settled their differences with complainant/respondent No.2. 2.
Learned counsel for respondent No.2 confirms the factum of the compromise having been effected between the parties and states that respondent No.2 has no objection to the quashing of the FIR in question. MOHIT 2025.02.28 15:15 I attest to the accuracy and integrity of this order/judgment
CRM-M-44807-2024 3.
In that view of the matter, even if this case is taken to its logical conclusion, it would only be an exercise in futility as the parties have already settled their differences. Therefore, no purpose would be served in wasting the time and resources of the State in pursuing this case to its pre-ordained end. It would, therefore, be better to give a quietus to the issue at this stage. 4.
Accordingly, the petition is allowed and FIR No.136 dated 25.07.2024 for the offence punishable under Sections 115(2), 303(2) and 3(5) of BNS registered at Police Station Sadar, District Hoshiarpur, and all other consequential proceedings arising therefrom shall stand quashed.
