(Oral) The challenge in this Letters Patent Appeal filed under Clause X of the Letters Patent is to the order dated 9th February, 2017, passed in CM No.1435-CWP of 2017 in CWP No. 25471 of 2016, titled as, "Partap Singh Narwal Vs. State of Haryana and others", whereby, the prayer for staying the appointment of respondent No.5 was declined by the learned Single Judge.

At the outset, learned counsel for the appellant states that the main case is fixed for 14th July, 2017 and in terms of Annexure P-9, respondent No.5 has been appointed till 31st May, 2017. A prayer was made by the learned counsel for the appellant that he may be allowed to withdraw the present appeal with liberty to the appellant to approach the learned Single Judge for preponing the date of hearing in the writ petition prior to 31st May, 2017.

Dismissed as withdrawn. It shall, however, be open to the appellant to take action by moving an appropriate application in the writ petition, in accordance with law.
