Seeking setting aside of order dated 13.10.2023 passed by Additional Sessions Judge whereby application filed under Section 319 CrPC for summoning respondents No.2 to 6 as additional accused has been dismissed, the petitioner-complainant has come up before this Court by filing the present revision petition with an application for condonation of delay of 565 days in filing the petition. 2.

State counsel submits that in the interregnum, other persons who were being prosecuted have already been convicted under Section 307 r/w 34 IPC. 3.

Since the grievance of the complainant was regarding the discharge of other accused, the convicting Court did not proceed under Sections 148, 149, 379 IPC, as such now the complainant himself will be prejudiced, if the application is allowed. 4.

Faced with the situation, counsel for the petitioner wishes to withdraw the present petition with liberty to become a party in the appeal filed by the convict, if any challenging the conviction. The complainant is also permitted to file an application for becoming respondent in the appeal filed by the convicts namely Shokeen and Jafru. All pending applications, if any, stand disposed of.
