(ORAL) After the matter was heard for some time, learned counsel for the appellant submits that interest of justice shall stands served in case learned Single Judge is requested to decide the pending writ petition expeditiously and in that eventuality he will withdraw the appeal which is directed against an interim order dated 31.05.2018.

A serious question with respect to maintainability of this appeal directed against the interim order is in issue. However, since final adjudication in the writ petition would be in the better interest of both the parties, we permit the appellant to withdraw the appeal and dispose of the same accordingly with a request to learned Single Judge to decide the writ petition pending before him as expeditiously as possible preferably within a period of one month from today.
