Sat Parkash and another
...Respondents
CORAM:
HON'BLE MR. JUSTICE H.S. MADAAN Present:- Mr. R.K. Hooda, Advocate for the appellant.
Mr.Sudhir Aggarwal, Advocate for the respondents. *** Learned counsel for the respondents contends that respondents have already taken possession of the suit property from the appellant on 27.5.2015 in execution proceedings and the execution application has been dismissed as satisfied on 29.5.2015, therefore, the present appeal has become infructuous. Learned counsel for the respondent has placed on file supporting documents in that regard.
In view of the statement made by learned counsel for the respondents and the documents placed on record by him, learned counsel for the appellant could not controvert such submissions made by learned counsel for the respondent or point out anything which might have gone to show that the documents filed by learned counsel for the respondents are not genuine. Therefore, the present appeal has become infructuous and is dismissed accordingly. (H.S.
