The present petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case FIR No.197 dated 28.08.2022, registered under Section 22 of NDPS Act, at Police Station Sadar Samana, District Patiala.

Learned State counsel submits that the petitioner who has filed this 2nd bail application after the 1st was withdrawn on 17.05.2023, has been in custody for only 1 year, 2 months and 14 days and charges in this case have been framed on 12.04.2023.

Learned counsel for the petitioner prays for withdrawal of the instant petition at this stage.
