-.- JAISHREE THAKUR J. (ORAL) The petitioner herein is assailing the order dated 12.02.2014 whereby he has been dismissed from service by invoking Article 311(2) (b) of the Constitution of India. The petitioner would contend that no cogent reasons have been given therein as to why it would not be possible to hold a departmental enquiry.

Learned counsel appearing on behalf of the respondent-State while replying to the preliminary submissions would submit that the instant writ petition is not maintainable, keeping in view the fact that the petitioner has already approached this Court by way of filing CWP No.7918 of 2015 titled as Lakhbir Singh Vs. State of Punjab and others and by detailed order dated 14.07.2015, the said writ petition was dismissed. It is submitted that the petitioner herein cannot be permitted to re-agitate the claim which has already been decided.

Faced with this position, counsel for the petitioner does not press the instant petition with liberty to avail any remedy available to him in accordance with law.

Ordered accordingly.
