CM No.3685-LPA of 2018 For the reasons mentioned in the application, the same is allowed and the delay of 52 days in filing the present appeal is condoned. LPA No.1358 of 2018 The appeal assails the order dated 11.09.2017 passed by learned Single Judge, whereby learned Single Judge, while directing for payment of salary for the period during suspension from 1992 to 2001, did not grant any interest.

LPA No.1358 of 2018 (O&M) -22.

We find that the writ-petitioner was involved in a criminal case whereafter trial, he was ultimately acquitted on 31.01.2008. 3.

In view thereto, the action of non-payment of salary during the suspension period from 1992 to 2001 cannot be said to be unjustified and the interest, therefore, would not accrue. The claim for interest is rejected. 4.

The present appeal is dismissed.
