The instant Letters Patent appeal is directed against an interlocutory order passed by learned Single Judge after noticing the rival contentions, to the effect that the first writ petitioner (before the learned Single Judge) may be offered appointment subject to final outcome of the writ petition.

In our considered view the said order fully protects the interest of the appellant, for if the learned Single Judge eventually finds that the first writ petitioner is not entitled to appointment, his claim can be rejected as his appointment is subject to final outcome of the writ petition. No case to issue any further interim direction at this stage is made out.

Dismissed.
