This is a petition under Sectio on 482 Cr.P.C. for quashing of FIR No.98, dated 30.06.2019, under Sectio ons 323, 324, 307, 148, 149 of the IPC, re egistered at Police Station Ma aqboolpura, District Amritsar, alongwith a all subsequent proceedings arisi ing therefrom, on the basis of compromise e (Annexure P-2).

This Court while issuing notic ce of motion vide order dated 09.09.2024, , directed the parties to appear r before the trial Court/Illaqa Magistrate f for recording their statements wi ith regard to the compromise.

Pursuant to the aforesaid order, report dated 05.11.2024 has been received from the Judicial Magistrate Ist Class, Amritsar. A perusal of the said report reveals that statements of the concerned persons have been recorded in the present case, who have stated that the matter has been settled between them and they have no objection in case the FIR in question is quashed. The compromise effected between them is genuine, without any undue influence and coercion. It is stated in the report that there are six accused. None of the accused has been declared as proclaimed offender and are not involved in any other FIR. 4.

With regard to the persons arraigned in the present case, learned counsel for the petitioners submits that the above-noted FIR was registered against three accused i.e. Gursewak Singh, who stands acquitted, and both the petitioners. Further that, on the statement of aforesaid Gursewak Singh, cross GD No.31 dated 02.07.2019 was registered against Harpreet Singh, Lakhbir Singh and Rashpal Singh, which has been quashed by this Court, vide order dated 13.12.2024 passed in CRM-M-54718-2024. As such, the present petitioners are the only persons to face trial in the above-noted FIR. Further that, injury No.2 on the person of complainant has not been declared dangerous to life, rather grievous in nature and remaining are simple.

Resultantly, the present petition is allowed and FIR No.98, dated 30.06.2019, under Sections 323, 324, 307, 148, 149 of the IPC, registered at Police Station Maqboolpura, District Amritsar, and all the subsequent proceedings arising therefrom, are quashed qua the petitioners on the basis of the compromise, Annexure P-2.
