(ORAL) Having argued the matter at length and faced with a situation that the writ petition preferred by the appellant as also this intra court appeal under Clause X of the Letters Patent is nothing but an abuse of process, learned counsel for the appellant prays that he be permitted to withdraw the appeal.

We are constrained to record that having delved into the background of the matter, we are more than convinced that the proceedings initiated by the appellant are indeed frivolous and, thus, the appeal at hands required to be dismissed with exemplary costs. LPA-1426-2018 (O&M) counsel for the appellant made every possible endeavour to persuade the Court to permit withdrawal of the appeal, upon a second thought, we rather deem it appropriate to grant his prayer, but subject to a cost of Rs.5,000/-. Accordingly, the appeal is dismissed as withdrawn, subject to a cost of Rs.5,000/- to be deposited with the Punjab and Haryana High Court High Court Employees' Welfare Association, within a period of one month from today.
