Ms.Bindu Goel, Advocate, who is present in the Court, accepts notice on behalf of the respondents/plaintiffs. After hearing learned counsel for the parties and with their consent, the present application is allowed. RSA No.1046 of 2015 and the applications attached therewith are pre-poned and taken on today's roster. RSA-1046-2015 Mr.Tribhawan Singla, Advocate, for the appellants/ defendants states at bar that he has instructions to make the
{2} following submissions:- (i) peaceful possession of the demised premises shall be handed over to the respondents/plaintiffs on or before 05.10.2015;
(ii) the decree passed in favour of the defendant/ plaintiffs shall be deemed to be executed as a whole; (iii) RSA No.1252 of 2015 filed by the appellant/ defendants with regard to mesne profit arising out of the same impugned judgment shall be withdrawn as not pressed as and when the same is listed before this Court.
In view of the above, learned counsel for the appellants prays for withdrawal of the present appeal. Mr.S.D.Sharma, learned Senior counsel appearing for the respondents submits that he has no objection to the above submissions made at bar by learned counsel for the appellants. As a sequel to the statements suffered by learned counsel for the appellants/defendants and accepted by the learned Senior counsel for the respondents, the present appeal and the criminal miscellaneous applications attached therewith are dismissed as withdrawn.
