******* SURINDER GUPTA, J.(Oral) After arguing for sometime, learned counsel for appellants seeks permission to withdraw this appeal with the submission that appellants are carrying on Halwai (Sweet) shop in the demised premises and will vacate the same within seven days after Diwali, which is on 30.10.2016.

Learned counsel for the respondent accepts the offer made by learned counsel for appellants.

In view of submission of learned counsel for appellants, the appeal is dismissed as withdrawn.

Appellants are allowed time upto 07.11.2016 to vacate and hand over vacant possession of the demised premises subject to the condition that entire arrears of rent due upto 31.08.2016 will be deposited within two weeks. From 01.09.2016, appellants will pay rent @ `20,000/- per month. They will file affidavit before the executing Court giving details Jitender Kumar 2016.09.12 10:11 I attest to the accuracy and integrity of this document

RSA-2460 of 2016 (O&M) -2of rent paid by them. Rent for the month of September, 2016 will also be paid within seven days. They will also give undertaking before the executing Court that they will vacate and hand over vacant possession of the demised premises to the respondent by 07.11.2016. Breach of any of the above terms will allow the respondent to execute the decree for possession forthwith.
