(ORAL) ase heard via Vide this petition, the petitioner seeks the concession of 'regular bail' under the provisions of Section 439 of the Cr.P.C., upon FIR no.138, dated 20.04.2021, having been registered at Police Station Sadar Gohana, District Sonepat, alleging therein the commission of offences punishable under Sections 307, 120-B and 506 of the IPC, read with Section 34 thereof, as also Section 25/27 of the Arms Act, 1959.
Learned counsel for the petitioner submits that it is not a case of any injury sustained by any person in the occurrence that is alleged to have taken place, and even the gun shot that is alleged to have been fired was not by the petitioner, who has now been in custody for about 9 months, with the trial still DINESH 2022.01.09 19:31 I attest to the accuracy and integrity of this document

As regards the stage of the trial and the fact that it is a case of no injury, learned State counsel could not deny the factual position. That being so,
the petition is allowed and the petitioner is ordered to be released on bail, subject to his furnishing adequate bail bonds and surety bonds to the satisfaction of the trial court.
