*** NIDHI GUPTA, J. (ORAL) Prayer in this application filed under Order 22 Rule 3 read with Section 151 CPC is for impleading the applicants herein as the appellants/who are the legal heirs of the deceased Ram Partap/appellant. Notice of the application.

On the asking of Court, Mr. A.K.Khunger, Advocate accepts notice on behalf of non-applicant/respondent No.2 and has no objection if the application is allowed.

Heard.

-2 - For the reasons stated in the application, which is supported by an affidavit of the newly added appellant No.1, the same is allowed and the applicants are hereby impleaded as the appellants. Amended memo of parties filed along with the application is taken on record. Office to tag the same at the appropriate place. CM-2287-C-2025 Prayer in this application under Order 23 Rule 3 CPC read with Section 151 CPC is to dispose of the instant appeal on the basis of Compromise Deed dated 05.12.2024 effected between the parties (Annexure A-2).

In view of averments mentioned in the application, the same is allowed and the main appeal fixed for 14.07.2025 is preponed for today and taken on board. Compromise Deed dated 05.12.2024 effected between the parties is also taken on record as Annexure A-2. Learned counsel for the appellants submits that he may be permitted to withdraw present appeal as the compromise has been effected between the parties.

Learned counsel for respondent No.2 does not dispute the above said fact.

Permitted to do so.

Dismissed as withdrawn.
