*** MANOJ BAJAJ, J. (Oral) Petitioners have approached this Court under Section 438 Code of Criminal Procedure to seek anticipatory bail in case FIR No.0159 dated 21.11.2021 under Sections 379, 447 and 34 of Indian Penal Code, 1860 registered at Police Station Nathana, District Bathinda, who apprehends their arrest at the hands of Police.

Learned counsel for the petitioners has argued that the petitioners are innocent, who had been falsely implicated in the above FIR and in fact, petitioners purchased land in question from Manjit Kaur and Sukhdeep Kaur through sale deed No.1792 dated 18.12.2020, registered with Sub Registrar, Nathana and are co-sharers of complainant. According to him, the complainant raised objection to the mutation, but the same was duly sanctioned in his favour on 25.1.2021. CRM-M-54002-2021 -2Kuldeep Singh being owner of the land in question, therefore, it is debatable, if the alleged offence of theft of crop or tresspass would be made out. He prays for bail.

Learned State counsel has filed reply dated 16.03.2022 and on instructions of HC Jaskaran Singh states that the petitioner has joined the investigation and is not required for custodial interrogation for the time being.
