ARVIND SINGH SANGWAN, J. (Oral) The petitioner prays for grant of regular bail under Section 439 of the Code of Criminal Procedure (in short 'Cr.P.C.') in FIR No.98 dated 04.07.2019, for offence punishable under Section 420 of the Indian Penal Code (in short 'IPC') registered at Police Station City Batala, Police District Batala, District Gurdaspur. Counsel for the petitioner has submitted that as per the allegations in the FIR, the police party received a secret information that the petitioner - Gurpreet Singh @ Gora along with his companions is asking the innocent persons that if they gave them Rs.10,000/- then, they will given them fake currency of Rs.50,000/-. The police, thereafter, arrested the petitioner and 16 packets of white papers, scissors and some chemicals were recovered from the petitioner.
It is further submitted that the petitioner is in in custody since 04.07.2019; the investigation is complete; challan stands presented and the petitioner is not involved in any other case. MOHD YAKUB 2019.10.
CRM-M No.42453 of 2019 Counsel for the State, on instructions from ASI Bhagirath Singh, has not disputed the factual position that no fake currency was recovered from the petitioner and he is not involved in any other case but opposed the prayer for bail.
Without commenting anything on merits of the case, considering the fact that the petitioner is not involved in any other case; the FIR has been registered under Section 420 IPC, which is triable by the Court of Magistrate and the conclusion of the trial is likely to take some time, this petition is allowed and the petitioner is directed to be released on regular bail subject to his furnishing bail/surety bonds to the satisfaction of the trial Court/Illaqa Magistrate/Duty Magistrate. However, it will be open for the prosecution to apply for cancellation of bail, if the petitioner is found involved misusing the concession of bail, in any manner.
