Instant writ petition has been filed inter alia for issuance of a writ in the nature of mandamus directing the official respondents to transfer the investigation in FIR No.247, dated 11.05.2023, for offences under Sections 323 and 506, IPC, and FIR No.248, dated 11.05.2023, for offences under Sections 295A, 500, 504, 505 and 509, IPC, and Sections 45, 67A and 67B of Information Technology Act, 2000, both registered at Police Station Krishna Gate, District Kurukshetra, Annexures P-7 and P-8, respectively, and to conduct a fair and impartial investigation. Another prayer has been made for directing the official respondents to follow mandate of law as laid down by the Supreme Court in Arnesh Kumar Versus State of Bihar (2022) 10 SCC 51. Status report by way of affidavit of Mr. Sunil Kumar HPS, Deputy Superintendent of Police, HQ, Kurukshetra, has been filed on behalf of respondents No.1 to 6, which is taken on record. It has been stated that on completion of the investigation in FIR No.247, dated 11.05.2023, final report under Section 173 (2), Cr.P.C., has been presented before the Court concerned on 21.07.2023. Upon instructions, State counsel submits that the investigation in FIR No.248, dated 11.05.2023, has been completed, and is pending for prosecution sanction before the competent authority. He has further instructions to state that the petitioner, who is a Mahant, cannot be granted any relief, as he has not been appearing before the Trial Court since March, 2025, and warrants of arrest have been issued for his arrest.

In view of above development, both prayers made in the instant petition do not survive.

Petition is dismissed.
