This petition has been filed by the petitioner under Section 438 Cr.P.C. for issuance of directions to Arresting/Investigating Officer to release the petitioner on bail in the event of his arrest in case FIR No.105 dated 23.09.2020, under Section 379-B IPC, registered at Police Station Kahnuwan, District Gurdaspur.

In view of the law laid down by Hon'ble Supreme Court in Prem Shankar Prasad vs. State of Bihar and another, 2021 (4) RCR (Criminal) 598, State of Madhya Pradesh vs. Pradeep Sharma, 2014

(1) RCR (Crl.) 269 and Lavesh vs. State (NCT of Delhi), 2012 (4) RCR (Criminal) 240, wherein it has been held that anticipatory bail is not maintainable at the instance of the proclaimed offender, faced with this, learned counsel for the petitioner wishes to withdraw the present petition. Dismissed as withdrawn.
