By way of present petition filed under Section 12 of the Contempt of Courts Act, 1971, prayer has been made for initiating contempt proceedings against the respondents for alleged willful non-compliance of the order dated 02.11.2023 passed by this Court in CWP-10084-2021. 2.

Learned counsel for the respondents has filed a compliance report dated 01.10.2024 and refers to speaking order of the even date and informs that the payment due to the petitioners towards 9% interest per annum shall be released to him within a period of two weeks and the possession of plot in question shall be delivered within 4 weeks from today. 3.

In view of the aforesaid undertaking, learned counsel for the petitioners does not press the present petition at this stage and submits that the same be disposed of with liberty to revive the same in case needful is not done.

Ordered accordingly.

However, in case the needful is not done within the aforementioned period, as per the undertaking, the petitioner would be at liberty to seek revival of the contempt petition and in that eventuility, the respondents would be liable to pay additional sum of Rs.50,000/- as costs from their own pocket in favour of the petitioners towards litigation expenses, immediately, i.e. on the first date of listing of revival application. 6.

Beside it, allotment was made in favour of petitioners in the year 2016, whereas, they are running after respondents for a delivery of

COCP-3336-2024 possession, in case the order dated 01.10.2024 passed by respondent No.2 is not complied with within 4 weeks from today, his salary shall remain stayed till the compliance of the order.

Rule stands discharged.
