Shambhu Kumar v. Nihal Chand
2023:PHHC:055671
IN THE HIGH COURT OF PUNJAB AND HARYANA
AT CHANDIGARH RSA No. 145 of 2015 (O&M) DATE OF DECISION :- April 20, 2023 Shambhu Kumar ...Appellant
Versus
Nihal Chand
...Respondent
CORAM:
HON'BLE MR. JUSTICE H.S. MADAAN Present:- Ms. Bindu Goel, Advocate for appellant.
Mr. Kulvir Narwal, Advocate with Mr. Satish Kumar, Advocate for the respondent. *** Despite grant of more than sufficient time the appellant has not affixed ad valorem Court fee on the grounds of appeal. His prayer for being allowed to sue as an indigent person had been rejected vide order dated 4.7.2017 and he was granted one month's time to affix the ad valorem Court fee. That time has since long elapsed. Even now the ad valorem Court fee has not been affixed. Learned counsel for the appellant states that on account of poor financial condition of appellant he is unable to affix the requisite Court fee. That is no justification for non-compliance with order of this Court.
Under the circumstances, the appeal stands dismissed. (H.S. MADAAN) JUDGE April 20, 2023 p.singh Whether speaking/reasoned Yes/No Whether Reportable Yes/No PARVINDER SINGH 2023.04.21 15:25 I attest to the accuracy and integrity of this order/judgment Chandigarh
